IRS Tackles "Independent Contractors"

The IRS is targeting organizations who misclassify their employees as independent contractors and plans to audit 500 exempt organizations this year. Notice a bit of a theme in today's issue. Argy, Wiltse & Robinson tax partner Jeff Schragg, who advises non-profits, tells us that throughout the recession, some organizations have tried to cut costs from payroll tax by firing employees then re-hiring them as independent contractors. "The IRS would say, 'Well, hold it. Nothing changed. They're still an employee," Jeff says. He adds that the IRS is not bound by the organization's own characterization of an employee vs. independent contractor.
